  1. Scope

 The following terms and conditions apply to all orders via our online shop.

Our online shop is aimed exclusively at consumers. A consumer is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

 

  1. Contractual partner, conclusion of contract

The purchase contract is concluded with Play Art Multimedia Handels GmbH. The presentation of the products in the online shop does not represent a legally binding offer, but rather a non-binding online catalog. You can first place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the information provided for this in the ordering process and use the correction aids explained. By clicking the order button, you place a binding order for the goods contained in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after sending the order. When the contract with us comes into effect depends on the payment method you choose:

 

Klarna invoice

We accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within two days.

 credit card

When you place your order, you also send us your credit card details. Once you have been authenticated as a legitimate cardholder, we will request your credit card company to initiate the payment transaction and thereby accept your offer.

 PayPal, PayPal Express

During the ordering process you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.

 Immediately by Klarna

After placing the order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. This means that the contract with us is concluded.

Amazon Pay

During the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. There you can choose the delivery address and payment method stored on Amazon and confirm the payment instruction to Amazon. You will then be redirected back to our online shop, where you can complete the ordering process. After placing the order, we request Amazon to initiate the payment transaction and thereby accept your offer.

 

  1. Contract language, contract text storage

The language available for concluding the contract is German.  We save the contract text and send you the order details and our general terms and conditions by email. You can view the contract text in our customer login.

 

  1. Delivery conditions / shipping

Delivery is only possible to delivery addresses within Germany, Austria and Switzerland. Shipping within Germany and Austria is free. The shipping costs for delivery to a Swiss address are CHF 6.00. The order will be delivered exclusively via shipping.

If the buyer sends the item again due to an incorrect address, we reserve the right to charge a flat rate for shipping costs retrospectively. The flat rate is €4.99 / CHF 6.00. It is the buyer's responsibility to check all information before completing the ordering process.

 

  1. Payment

The following payment methods are generally available in our shop:

 credit card

When you place your order, you also send us your credit card details. Once you have been authenticated as a legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after placing your order. The payment transaction is automatically carried out by the credit card company and your card is charged.

 PayPal, PayPal Express

During the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, identify yourself with your access data and confirm the payment instructions to us. After placing the order in the shop, we request PayPal to initiate the payment transaction.  The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further information during the ordering process.

Immediately by klarna

After placing your order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have an online banking account with a PIN/TAN procedure that has been activated for participation in Sofort, identify yourself accordingly and confirm the payment instruction to us. You'll get more information during the ordering process. The payment transaction will be carried out by Sofort immediately afterwards and your account will be debited.

 Amazon Pay

During the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. In order to be able to process the ordering process via Amazon and pay the invoice amount, you must be registered there or first register and authenticate yourself with your access data. There you can choose the delivery address and payment method stored on Amazon, confirm the use of your data by Amazon and the payment instructions to us. You will then be redirected back to our online shop, where you can complete the ordering process. Immediately after placing the order, we request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon. You will receive further information during the ordering process.

 Purchase on account via Klarna

In collaboration with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you purchase on account as a payment option.  Please note that Klarna invoices are only available for consumers and that payment must be made to Klarna.  When purchasing on account with Klarna, you always receive the goods first and you always have a payment deadline of 14 days.

  1. Retention of title

The goods remain our property until full payment.

 

  1. Transport damage

If goods are delivered with obvious transport damage, please report such errors immediately to the delivery person and please contact us immediately. Failure to make a complaint or contact us has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.


  1. Warranty and guarantees

The statutory liability law applies. The following applies to used goods: If the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.

  1. Legal right of withdrawal

You can find information about the legal right of withdrawal here. The statutory right of withdrawal is essential for both parties. This applies primarily and for 14 working days from the delivery date.

 

  1. Contractual right of return

In addition to the statutory right of withdrawal for consumers and users in accordance with clause 9 above, we grant you a contractual right of return.

The right of return applies to all items purchased via the Martello online shop. This applies to all products unless otherwise stated. For products purchased via marketplaces other than the Martello online shop www.martello-coffee.com, the respective contractual conditions of the respective provider apply.

10.1 Return of complete order

For orders with an order total of over 150.00 euros that were placed over 30 days ago and are returned in full, we keep the Play Art Multimedia Handels GmbH, proposes to create a voucher for the full purchase price instead of a purchase price refund. This is then valid for 3 years to the end of a calendar year from issue. Exceptions are possible.

If an order with a value of more than 30.00 euros is returned to us in full, we, Play Art Multimedia Handels GmbH, reserve the right to charge a flat rate shipping fee of 4.50 EUR to be retained. The amount of the respective order will be refunded to the specified payment method, less the flat rate, within 14 working days.

 

  1. Undeliverable delivery

If your order cannot be delivered after several attempts for reasons beyond our control, it will be returned to us. In this case, we assume that you want to withdraw from the contract, which will then automatically be converted into a refund obligation. As a consequence, we will immediately, but no later than 14 days after cancellation, refund all payments received from you, excluding shipping costs (with the exception of additional costs resulting from you using a shipping method other than the standard shipping method offered by us have chosen).

 

  1. Discounts, discount codes & Snock's Gift Cards

 

11.1 Discounts & Discount code usability

 

Each discount code can only be used once per purchase and per customer.

Only one discount code can be used per order. It is not possible to combine different discount codes. The combination of bundles and discount codes is not possible.

If a discount code is applied to an already reduced offer price (larger packaging unit / bundle), the discount will be deducted from the individual price. Cash payment of discount codes is not possible, nor is any other offsetting or reimbursement of the monetary value of a discount code. Discount codes issued to the customer are excluded from resale and assignment is not permitted. The discount codes only apply to the Martello online shop (https://martello-coffee.com).

 

Validity:

 

The validity period of the discount codes is limited. The discount codes expire after the date stated on the discount code. An extension is excluded.

 

Minimum order value:

A minimum order value is always stated in the detailed information of the respective discount code. If you subsequently fall below the minimum order value By returning the relevant item, Play Art reserves the right to charge the difference between the order with the discount code and the order without the discount code. Discount codes that are given when you register for the newsletter are valid for a minimum order value of 25.00 CHF.

 

Returning items:

If you make use of your right of withdrawal or if the goods are returned for other reasons, only the reduced purchase price will be refunded. There is no entitlement to a refund of the discount code or to a new discount code.


Billing for multiple items:

If an order to which a discount code is applied consists of several items (shopping cart discount), Play Art reserves the right to divide the discounted amount over one or proportionally over several items .

 

Failure to fulfill an order or delivery:

If the order or individual items to which the discount code relates are not fulfilled, there is no entitlement to a refund of the value of the discount code or a claim to a new discount code.

 

Discount codes via third parties:

The redemption of discount codes, vouchers or other bonus systems from third-party providers, such as Miles&More, Paypal, PayBack, Otto.de or Amazon, are not valid. We are not responsible for the timeliness of offers or discount codes on third-party sites.

 

11.2 Gift Cards

Usability:

The gift cards can be purchased via the online shop. These have a value of EUR 25.00 or EUR 50.00, which can be determined before the purchase is completed. The gift cards are only valid for the Martello online shop (https://www.martello-coffee.com).

 Validity:

All Gift Cards are valid for three years from the date of purchase. They can be redeemed on all products in the online shop. There is no minimum order value.

 Return of items:

The right of return remains unaffected. The specified terms and conditions apply. If a product is returned or refunded, the amount owed will be credited back to the voucher. A payment of the amount to any means of payment other than the voucher is excluded.

Return of the voucher / gift card:

A return, for example in 2x 25 EUR gift cards, is excluded. A cash payment of the full or remaining amount is also not possible.

  1. Liability

The above restrictions and shortened deadlines do not apply to claims due to damage caused by us, our legal representatives or vicarious agents. Our liability is always unlimited:

 

in the event of injury to life, body or health, in the event of intentional or grossly negligent breach of duty, in the event of a guarantee promise, if agreed, or if the scope of application of the Product Liability Act is open. In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose compliance the contractual partner can regularly rely, (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, the liability is limited to the amount foreseeable at the time the contract was concluded Damage that typically has to be expected is limited.   1. Dispute resolution
